1. About Krux AI

Krux AI ("we", "our", or "us") provides tools for analysing product experiences through AI-assisted video and transcript analysis.

2. Eligibility

You must be at least 16 years old and capable of forming a binding contract under applicable law to use the Service.

If you use the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

3. Your Account

• You must provide accurate information and keep it up to date.
• You are responsible for maintaining the confidentiality of your login credentials (Google sign-in or email OTP).
• You are responsible for all activity that occurs under your account.
• We may suspend or terminate your account if you violate these Terms or misuse the Service.

4. Use of the Service

You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:

• Upload or share illegal, harmful, or infringing content.
• Attempt to reverse engineer, interfere with, or circumvent any Service security features.
• Use the Service to build a competing product.
• Abuse our infrastructure or exceed reasonable usage limits.

We reserve the right to remove or restrict content that violates these Terms or applicable law.

5. Uploaded Content and Ownership

You retain ownership of all content (videos, transcripts, screenshots, etc.) you upload.

By uploading content, you grant Krux AI a limited licence to process, analyse, and display it to you for the purpose of providing the Service.

This licence is non-exclusive, revocable, and limited to operating and improving the Service.

We do not use your content to train our own or third-party AI models beyond the analysis requested by you.

6. AI Processing and Third-Party Services

To deliver results, Krux AI may send portions of your content to trusted sub-processors:

• OpenAI LLC – to generate transcripts (Whisper) and UX analysis (GPT models).
• Supabase Inc. – for authentication, database, and storage.
• Stripe Inc. – for payments.
• n8n GmbH – for automation.
• Elestio – for hosting.

Each processor handles data in accordance with its own security and privacy standards as detailed in our Privacy Policy.

7. Payments and Subscriptions

• Paid plans are billed through Stripe.
• Prices and features are shown at checkout and may change with notice.
• You may cancel your subscription at any time through your account settings; access continues until the end of the billing period.
• Refunds are granted only where required by law or explicitly stated in a promotional offer.
• Taxes (e.g., VAT) may apply depending on your location.

8. Intellectual Property

All Service code, design, and materials (excluding user-generated content) are owned by Krux AI and protected by copyright, trademark, and other laws. You may not reproduce, modify, or distribute our materials except as permitted under these Terms.

9. Service Availability and Changes

We aim to provide reliable uptime but do not guarantee uninterrupted access.

We may update, modify, or discontinue parts of the Service at any time, with or without notice. Major changes will be communicated in advance when feasible.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind.

We do not guarantee accuracy, reliability, or suitability for any particular purpose. You use the Service at your own risk.

11. Limitation of Liability

To the maximum extent permitted by law:

• Krux AI will not be liable for any indirect, incidental, consequential, or special damages arising from or related to your use of the Service.
• Our total liability for any claim shall not exceed the amount paid by you to Krux AI in the 3 months preceding the event giving rise to the claim.

12. Indemnification

You agree to indemnify and hold harmless Krux AI and its affiliates from any claims, damages, or losses arising from your use of the Service or violation of these Terms.

13. Termination

You may stop using the Service at any time.

We may suspend or terminate access if you breach these Terms or misuse the platform. Upon termination, your right to access the Service ceases, but sections relating to intellectual property, limitations of liability, and dispute resolution will survive.

14. Governing Law and Jurisdiction

These Terms are governed by the laws of England and Wales, without regard to conflict-of-law principles.

Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.

15. Changes to These Terms

We may update these Terms occasionally. When we do, we'll update the "last updated" date and, where material, notify users via the platform or email.
